WASHINGTON, D.C.—In a packed session Wednesday, Supreme Court justices delivered a crushing reality check to President Donald Trump’s bid to end birthright citizenship, despite briefly entertaining the idea of only granting citizenship to babies who can pass a pop quiz on U.S. history and emerge from the womb holding mini American flags.
Observers watched as Chief Justice John Roberts meticulously grilled Solicitor General Bruce Hingleberry, asking whether the 14th Amendment could be retroactively amended by presidential order or, failing that, a strongly worded tweet. “Traditionally, the Constitution has not responded to ALL CAPS,” Roberts observed, adding, “But perhaps it’s time to reconsider.”
